Ohio governor commutes obese killer's sentence to life in prison

CLEVELAND (Reuters) - Ohio Governor John Kasich on Monday commuted the death sentence of an inmate who had sought mercy because he is obese, saying the man's legal representation was not adequate and he should spend the rest of his life in prison.

Ronald Post, 53, who weighs more than 450 pounds, was scheduled to be executed by lethal injection on January 16 for the aggravated murder in 1983 of motel desk clerk Helen Vantz. A parole board panel recommended on Friday that his death sentence be commuted to life in prison.

"Regardless of the heinous nature of their crime, a criminal defendant is entitled to an effective defense, especially in a death penalty case," Kasich said in a statement. "The Parole Board's conclusion is that Ronald Post did not come close to receiving such a defense. After my own careful review, I agree."

Kasich said the decision to commute Post's sentence "should not be viewed by anyone as diminishing this awful crime or the pain it has caused."

Obama to join mourning Connecticut families in search for answers

NEWTOWN, Connecticut (Reuters) - President Barack Obama arrives in Connecticut on Sunday to mourn the dead and console the survivors of a gunman's rampage that killed 20 children, all 6 and 7 years old, after he forced his way into their school and shot them multiple times.

Governor Dannel Malloy on Sunday became the latest public figure to call for new gun control measures following Friday's rampage that left 28 dead, including the gunman who used high-powered firearms.

"These are assault weapons. You don't hunt deer with these things," Malloy said on the CNN program "State of the Union."

Obama's appearance at an interfaith vigil in the once-tranquil town of Newtown will be watched closely for clues as to what he meant when he called for "meaningful action" to prevent such tragedies in the wake of the massacre on Friday.

The president arrives after authorities released the names of the dead on Saturday and more details emerged about the victims and the rampage itself.

After killing his mother at home, Adam Lanza, 20, forced his way into the Sandy Hook Elementary School and started firing at the children, most if not all with a powerful rifle - a military-style Bushmaster .223 M4 carbine - at close range. He also killed six adult women at the school and himself, putting the death toll at 28.

Though Americans have seen many mass shootings over the years, the victims have rarely been so young.

Malloy, referring to the shooter, said: "We know that he was a troubled individual, and that he went to school with a number of weapons which he used on his victims and ultimately used on himself. ... I'm sure we'll come to know more about him and his problems and his family."

Nancy Lanza legally owned a Sig Sauer and a Glock, both handguns commonly used by police, and the military-style Bushmaster long gun, according to law enforcement officials.

Those weapons were the ones used by her son in the massacre.

"The mother purchased them. And they have the patina of legal purchases. I mean, there's always a question: was she purchasing them for herself? ... If she was purchasing them for another individual, her son, then there's a question about that purchase," the governor said.

On Saturday, some Democratic lawmakers called for sweeping new gun-control measures, a move certain to encounter forceful opposition from the nation's pro-gun lobby.

Malloy, a Democrat, added his voice to the gun-control calls on Sunday. U.S. lawmakers have not approved a major new gun law since 1994, and they let a ban on certain semiautomatic rifles known as assault weapons expire in 2004.

Malloy lamented that the assault ban was allowed to lapse. He also said a lot of guns used in crimes in his state were actually purchased in other states and brought to Connecticut.

"Connecticut has a pretty aggressive law. Probably of the 50 states, I think we're ranked fourth most aggressive in trying to limit access to these kinds of weapons," the governor said.

Pope Benedict expressed his pain over the killings, telling crowds of pilgrims gathered in St Peter's Square in Vatican City on Sunday he was "deeply saddened."

"I assure the families of the victims, especially those who lost a child, of my closeness in prayer. May the God of consolation touch their hearts and ease their pain," the pope said. "Upon those affected by this tragedy, and upon each of you, I invoke God's abundant blessings!"

School district officials said classes would resume Tuesday, except at Sandy Hook. As of Saturday night, they were still working on a plan for how and where to let the school's kindergarten-through-fourth-grade classes resume.

Not another year of New Years Resolutions ? I find it ironic that every year we have a structure in our society which we tolerate where nine times out of ten we set ourselves up for so called ?failure? and another year goes by and we do it all again ? enough already!

I have a process in my education called the ?Ludicrousy Cycle?, and personally speaking New Years Resolutions are just ludicrous ? I do own however how this may land for some of you who diligently make a record of everything you wish to achieve and achieve it ? not aiming this at you ? top marks if this is the case BUT why are we so hell bent on gauging our success on goals we make at the start of the year which for the majority of the population we never achieve.

I have a vocation where I live each and breath goal setting, and not just at the start of the year ? don?t get me wrong, the psychology of a New Year is very powerful but not when it is a structure to keep us disempowered!

Here?s a question for you? ?How many people reading this blog today can say that they achieve what they set out to every year as a result of declaring it as a New Years resolution? ?If the percentage is high then all power to you, if the percentage is medium to low I have my take on why this is?

4. ? JUSTIFICATION ? we love using excuses as to why we cannot achieve xyz ? this lets us off the hook ? if you haven?t noticed it works! ?Couldn?t afford to do it, didn?t have the time, something else came up etc etc

5. ?JUDGMENT ? This is not only with New Years Resolutions but within the human psyche we tend to fly below the radar for showing up above the radar we get judged, assessed and criticized, and yes sometimes from our well meaning friends and family members, those closest to us! ?We can?t be too successful, we can?t stand out, we can?t be too selfish, and can?t be too showy?you get the jist

6. ?WANT VERSUS COMMITMENT PARADIGM ? we live in a false world stating that we are COMMITTED when all the time we are living on the court called ?WANT?. ?If you have not noticed the results are never produced on that court. ?When someone who legitimately thinks that they are committed is challenged, that they are not, they become very defensive because normally they are working their butts off with little or no results are happening ? why ? because they have not learnt the lesson of what it takes to be committed! ?Commitment = Results ? simple formula ? if the results are not produced in the area of your life that you state that you are committed, you are not committed ? sobering thought!

7. ?COURAGE ? there is an unwillingness to confront whats in the way, and an unwillingness ?to be with the resistance for it feels uncomfortable. ?Confrontation, resistance, and feeling uncomfortable are just feelings, they have no power unless you live at consequence to them. ?To be courageous is to embrace these feelings and take the required action anyway!

8. ?NO ROBUST PLAN ? I am a project management queen, I understand the power of planning ? 90% of projects fail because people do not spend time in the planning phase ? and for those who do put the effort in they are not disciplined in what it means to work to plan ? how crazy it that. ?Put all that effort in and then not be disciplined to follow through, why bother! ?Or theres those that love stating 50% complete, 70% complete and keep deferring out ? when you work to plan your word is gospel to accomplish what you say you will within a said timeframe ? NO MATTER WHAT!

9. ?FRUSTRATION ? the epidemic craziness in our society is living in the realm of DOING ? this is not fulfilling, nor satisfying ? what it is, is extremely FRUSTRATING! ?But we tolerate this. ?No one in their right mind would live in the mode of driving, striving forcing if they were associated to the costs of this type of behavior ? but we keep doing it!!! ?To alleviate frustration we need to learn the art of co-creating, thereby manifesting the results to come to us as a function of who we are BEING!

10. ?NO ACCOUNTABILITY OR SUPPORT ? name a successful person and I can guarantee they had support, they had guidance, they had people who held them to account. ?They had conviction from their soul that they would not allow anything to deter them from their goal/s.

So, do yourself a favor and DO NOT write down any New Years resolutions this year UNLESS you are willing to address these 10 points. ?I would prefer you to declare the following ? ?This year I am unwilling to write down any New Years Resolutions because I am unwilling to do what it takes to achieve them? ? that would be a more honest approach and it would save yourself a lot of heartache.

On the other hand if you are willing to do what it takes ? by all means ? GO FOR IT! ?And I commend you for your achievements in advance for I get what it takes to lead a committed life!

ScienceDaily (Dec. 6, 2012) ? Rows of new toys, endless racks of sweaters on clothing store shelves, long lines of books arranged in the bestsellers section at the bookstore. From mall displays to boutique exhibits, long lines of horizontally arranged products are the norm when it comes to the holiday shopping experience.

But how does a product's placement on the storeroom shelf influence which one a consumer ultimately chooses? It turns out that the shopper's eye has a very central focus.

"Consumers are more likely to purchase products placed in the middle of a display -- without even being aware of it," says Onur Bodur. The associate professor from Concordia's John Molson School of Business is co-author of a recent study in the Journal of Consumer Research, along with marketing researchers at HEC in France and the Aston Business School in England.

Using eye-tracking devices, Bodur and his colleagues investigated how location influences choices for a variety of products, including cosmetics and food items.

They found that consumers would increase their visual focus on the central option in a product display area in the final five seconds of the decision-making process -- and that was the point at which they determined which option to choose.

It turns out that the process is a subconscious one. When asked how they had come to choose which product to buy, consumers did not accurately recall their reasons for their decision. What's more, they were not aware of any conscious visual focus on one area of the display over another.

What does uncovering these unconscious habits mean for the average shopper? Greater awareness of buying behaviours should lead to more informed choices. Says Bodur, "by using this newfound knowledge that visual attention is naturally drawn to the center of a display, consumers can consciously train themselves to make a more thorough visual scan of what's on offer."

When it comes to holiday shopping, the visual equivalent to thinking outside of the box just might lead to savvier selections.

In a discovery with applications ranging from hair dyeing to electronic sensors to development of materials with improved properties, scientists are reporting the first synthesis of gold nanoparticles inside human hairs. Their study appears in ACS' journal Nano Letters.

Philippe Walter and colleagues explain that gold nanoparticles 40,000-60,000 of which could fit across the width of a human hair are a hot topic. Scientists are exploring uses, ranging from electronics and sensors to medical diagnostic tests and cancer treatments. Gold nanoparticles have been deposited on hair for use as electrodes, and gold nanoparticles had been used to dye wool. Walter's team looked at a new use dyeing hair, inspired by the ancient Greeks' and Romans' use of another metal, lead, to color their hair.

They describe the first synthesis of fluorescent gold nanoparticles inside human hair. It involved soaking white hairs in a solution of a gold compound. The hairs turned pale yellow and then darkened to a deep brown. Using an electron microscope, the scientists confirmed that the particles were forming inside the hairs' central core cortex. The color remained even after repeated washings.

Auburn hires ex-assistant Malzahn as head coach

AUBURN, Ala. (AP) ? Auburn has turned to Gus Malzahn to restore a program that made an unprecedented fall two years after winning a national title with Cam Newton operating his high-powered offense to perfection.

The school announced that it will introduce the former Arkansas State coach in a news conference Tuesday night.

Malzahn was the Tigers' offensive coordinator during their 2010 national championship run before heading to Arkansas State for his first college head coaching position.

He led the Red Wolves to a 9-3 record, a Sun Belt Conference title and a berth in the GoDaddy.com Bowl then parlayed that into a job in the powerhouse Southeastern Conference.

"It's an outstanding institution with a storied football program that I had the pleasure of experiencing firsthand for three years," Malzahn said in a statement. He thanked school representatives for their confidence "in my ability to turn this program around and to bring Auburn back to national prominence. This is a homecoming for me and I look forward to being reunited with the Auburn family."

Malzahn, 47, returns with his fast-paced, no-huddle offensive style. He replaces former boss Gene Chizik, who was fired one day after a 49-0 loss to No. 2 Alabama to complete a 3-9 season.

Before his arrival at Auburn in 2009, Malzahn had spent two seasons as Tulsa's offensive coordinator. He was the offensive coordinator at Arkansas for one year after a successful run in the Arkansas high school ranks.

Auburn had the nation's 115th-ranked offense last season, averaging 305 yards a game. The Red Wolves were ranked 19th in total yards under Malzahn.

It's the second straight time Auburn has turned to one of its coordinators from an unbeaten team. Chizik ran the defense for the 13-0 team in 2004 but was hired by the Tigers despite a 5-19 record in two seasons at Iowa State.

"We are tremendously excited that Gus Malzahn will be our next head football coach," athletic director Jay Jacobs said. "Coach Malzahn was the clear unanimous choice of our search committee, and I am pleased that Dr. Gogue has accepted our recommendation. This is a great day for Auburn football and Auburn University."

The search committee was comprised of Jacobs, Auburn Heisman Trophy winners Pat Sullivan and Bo Jackson and former Tigers player Mac Crawford.

Auburn owes more than $11 million in buyouts to Chizik and his coaching staff. Malzahn's contract and salary information was not immediately available.

The Tigers are hoping he can return them to success after a winless SEC season.

"Gus Malzahn is a proven winner," Jacobs said. "He is without question one of the brightest minds in college football and he has won everywhere he has been. Coach Malzahn knows what it takes to build a championship program in the Southeastern Conference. He knows our state and region and he understands what it will take to turn our program around. Coach Malzahn will also be an outstanding ambassador for Auburn University, and that was important to the committee."

The NCAA has been investigating the recruitment of signee Jovon Robinson, who was ruled ineligible after a guidance counselor admitted to creating a fake transcript.

The Tigers badly struggled in a transition to Scot Loeffler's pro-style last season, starting three quarterbacks.

Auburn was ranked in the top seven in rushing, total and scoring offense in 2010 and Newton won the Heisman Trophy in his lone season out of the junior college ranks. It was the Tigers' first national title since 1957.

Without Newton, the Tigers slipped to 100th in total offense in 2011 and then dipped even further.

The hiring reunites Malzahn with the quarterback he recruited out of Arkansas. Kiehl Frazier was benched last season after struggling as the starter. He was USA Today's national offensive player of the year as a high school senior.

Malzahn had been earning $1.3 million a year for the Tigers after interviewing with Vanderbilt after the national championship season. He took a substantial pay cut to join the head coaching ranks with the Sun Belt Conference team. Malzahn replaced Hugh Freeze, who also left after one season at Arkansas State to take over at Mississippi.

Chizik's tenure was marred by off-the-field problems, including the arrest of four players from the championship team for armed robbery.

Malzahn also made a couple of decisions with players that didn't pan out. Tailback Mike Dyer transferred from Auburn ? where he was suspended ? to Arkansas State. He was then dismissed by Arkansas State in July after a state trooper found marijuana and a gun in a car the national title game MVP was driving.

Researchers discover master regulator of skin development

The surface of your skin, called the epidermis, is a complex mixture of many different cell types ? each with a very specific job. The production, or differentiation, of such a sophisticated tissue requires an immense amount of coordination at the cellular level, and glitches in the process can have disastrous consequences. Now, researchers at the Stanford University School of Medicine have identified a master regulator of this differentiation process.

"Disorders of epidermal differentiation, from skin cancer to eczema, will affect roughly one-half of Americans at some point in their lifetimes," said Paul Khavari, MD, PhD. "Understanding how this differentiation occurs has enormous implications, not just for the treatment of disease, but also for studies of tissue regeneration and even stem cell science." Khavari is the Carl J. Herzog Professor and chair of the Department of Dermatology.

Khavari and his colleagues have found that, like a traffic cop motioning cars to specific parking spaces in a large, busy lot, a newly identified molecule called TINCR is required to direct precursor cells down pathways toward particular developmental fates. It does so by binding to and stabilizing differentiation-specific genetic messages called messenger RNAs. Blocking TINCR activity, the researchers found, stopped the differentiation of all epidermal cells.

"This is an entirely unique mechanism, which sheds light on a previously invisible portion of the regulation of this process," said Khavari, who is also a member of the Stanford Cancer Institute and chief of the dermatology service at the Veterans Affairs Palo Alto Health Care System. He is the senior author of the research, which will be published online Dec. 2 in Nature. Former Stanford postdoctoral scholar Markus Kretz, PhD, is the first author. Kretz is now an assistant professor of biology at the University of Regensburg in Germany.

Surprisingly, this coordinator extraordinaire is not a protein. (Proteins have traditionally been thought to be the primary movers and shakers in a cell, although that view is now changing somewhat.) Instead, it belongs to a relatively new, and increasingly influential, class of regulatory molecules called long, non-coding RNAs, or lncRNAs. These molecules are so named because they do not carry instructions to make proteins. They are also longer than other regulatory RNAs known as microRNAs.

But even among lncRNAs, TINCR, and its role in epidermal differentiation, is unique.

"This work revealed a new role for regulatory RNAs in gene activation ? by stabilizing select messenger RNA transcripts," said co-author Howard Chang, MD, PhD, professor of dermatology. "This finding highlights the ability of regulatory RNAs to fine-tune gene expression."

The researchers identified the molecule by looking for RNAs that are more highly expressed in differentiating epidermal cells called keratinocytes than in progenitor cells. They found that levels of TINCR (short for "terminal differentiation-induced non-coding RNA") expression were 150 times greater in the keratinocytes. But to figure out what TINCR was doing, they had to develop two new assays: one to help researchers identify interactions between RNA molecules, and another to suss out interactions between a regulatory RNA and its protein partners. Such techniques will become increasingly important as researchers continue to identify the critical regulatory roles played by RNA molecules.

"These long, non-coding RNAs don't have recognizable, classic motifs like proteins do," said Khavari. "And yet, we really need to know with what other molecules they may be physically interacting to truly understand their biological roles."

The first approach, which the researchers termed RIA-Seq, couples an RNA interaction assay with a deep-sequencing technique to identify RNA partners of TINCR. Using RIA-Seq, the researchers found that TINCR and its RNA partners ? many of which encode instructions for proteins essential to the differentiation process ? share a common, short sequence that mediates their binding.

"These conserved, complementary motifs may help TINCR pair up with and stabilize its partner messenger RNAs," said Khavari. "In this way, TINCR may serve as a scaffold for many mRNAs involved in epidermal differentiation."

The second approach used a grid, or microarray, of 9,400 human proteins to which the researchers exposed TINCR. One of the proteins, termed STAU1, bound strongly to TINCR. STAU1 had not previously been implicated in epidermal differentiation, but the researchers found that blocking its activity prevented differentiation in a manner similar to blocking TINCR.

"This effect is quite specific for epidermal tissue," said Khavari, "and it suggests that nature has evolved a simple mechanism to control the tissue-specific expression of a large number of genes. We'd like to understand more about this TINCR-STAU1 complex to get a better idea of how it acts at a biochemical level."

In addition to identifying a unique role for a new lncRNA in epidermal differentiation, Khavari and Chang said they are excited to have developed new tools to understand how these regulatory RNAs function in the cells. "This really helps substantially expand our tool kit that we can use to analyze how RNAs and proteins interact," said Khavari.

(AP) ? Syria's civil war is closing in on President Bashar Assad's seat of power in Damascus with clashes between government forces and rebels flaring around the city Tuesday, raising fears the capital will become the next major battlefield in the 20-month-old conflict.

Numerous reports emerged of at least a dozen people killed near the ancient city and elsewhere, and the regime said nine students and a teacher died from rebel mortar fire on a school. The state news agency originally said 30 people had been killed in the attack.

While many of the mostly poor, Sunni Muslim suburbs ringing Damascus have long been opposition hotbeds, fighting has intensified in the area in recent weeks as rebels press a battle they hope will finish Assad's regime.

"The push to take Damascus is a real one, and intense pressure to take control of the city is part of a major strategic shift by rebel commanders," said Mustafa Alani of the Geneva-based Gulf Research Center. "They have realized that without bringing the fight to Damascus, the regime will not collapse."

The increased pressure has raised worries that he or his forces will resort to desperate measures, perhaps striking neighbors Turkey or Israel, or using chemical weapons.

NATO foreign ministers approved Turkey's request for Patriot anti-missile systems to be deployed along its southern border to defend against possible strikes from Syria.

"We stand with Turkey in the spirit of strong solidarity," NATO Secretary-General Anders Fogh Rasmussen told reporters after the meeting in Brussels. "To anyone who would want to attack Turkey, we say, 'Don't even think about it!'"

Before the meeting, Fogh Rasmussen said he expected any use of chemical weapons to get an "immediate reaction from the international community."

On Monday, President Barack Obama said there would be consequences if Assad made the "tragic mistake" of deploying chemical weapons, and Israeli Prime Minister Benjamin Netanyahu said he agreed with the U.S. position.

"We are of the same opinion, that these weapons should not be used and must not reach terror groups," Netanyahu said.

U.S. intelligence has seen signs that Syria is moving materials inside chemical weapons facilities recently, though it is unsure what the movement means. Still, U.S. officials said the White House and its allies are weighing military options should they decide to secure Syria's chemical and biological weapons.

In July, Foreign Ministry spokesman Jihad Makdissi told a news conference that Syria would only use chemical or biological weapons in case of foreign attack, not against its own people. The ministry then tried to blur the issue, saying it had never acknowledged having such weapons.

On Monday, Lebanese security officials said Makdissi had flown from Beirut to London. He has not spoken publicly in weeks and it was unclear whether he had left the government.

NATO foreign ministers also met with their Russian counterpart, Sergey Lavrov. The Kremlin has stymied more than a year of international efforts to apply global pressure on the Assad regime, its strongest ally in the Arab world, but officials say it has expressed equal concern about the threat of any chemical weapons.

Speaking to reporters, Lavrov said Russia wouldn't object to the Patriots.

"We are not trying to interfere with Turkey's right" to defend itself, he said. "We are just saying the threat should not be overstated."

Lavrov stressed that Syrian artillery strikes into Turkey were accidental. And he warned that the conflict "is being increasingly militarized."

Rebel groups around Syria have scored victories in recent weeks, overrunning military bases and airports and halting air traffic at the capital's international airport for days.

The government's response has been harsh, and suburbs to the east and south of Damascus have seen some of the heaviest fighting since July, when rebels seized neighborhoods in the capital itself before being routed by government troops.

Death tolls in the area have soared. On Tuesday, reports emerged of at least four killings of at least a dozen people, all of them near Damascus or in Aleppo, Syria's largest city and a battleground since the summer.

Syria's state news agency SANA said nine students and one teacher were killed when a mortar fired by "terrorists" ? the regime's shorthand for rebels ? hit a ninth grade classroom in the Al-Wafideen area. The housing project, about 25 kilometers (15 miles) northeast of central Damascus, houses 25,000 people displaced from the Golan Heights since the 1967 war between Syria and Israel.

SANA said earlier that 29 students and one teacher had been killed before reporting the lower number.

The opposition Syrian Observatory for Human Rights said 10 were killed and did not specify who fired the mortar.

The Britain-based group, which relies on contacts inside Syria, also said 17 unidentified bodies were found in the southern Damascus suburb of Thiyabiyeh. An activist video posted online showed the dead lined up on a floor, many of their heads bloody. An off-camera voice said they were shot after being detained at government checkpoints.

The Observatory also said 12 others were killed in a shelling attack on the Aleppo neighborhood of Bustan al-Qasr the day before. Online videos showed bloody and dismembered bodies on a sidewalk as people struggled to lift the wounded

Nearby, dozens of men stood in what the unidentified cameraman said was a bread line.

"We still see people standing in a long line despite a massacre to get bread," the cameraman says.

The Observatory also reported 13 dead in a separate attack Monday in Aleppo's Halak neighborhood.

The videos appeared genuine and corresponded to other reports on the incidents. Syria's government severely restricts media access, making independent confirmation nearly impossible.

Syria's uprising began with peaceful protests in March 2011 and later escalated into a civil war that the opposition says has killed more than 40,000 people. So far, both sides have refused international calls for a negotiated solution.

Most analysts agree that the tide is turning, however slowly, against the regime.

But Fyodor Lukyanov, editor of the foreign policy magazine Russia in Global Affairs, said Assad won't leave without a fight.

"Assad realizes that there is no way back for him," said Lukyanov, a leading Russian foreign policy expert with high-level Foreign Ministry connections. "If he tries to jump the boat, his own supporters will not forgive him for doing that. And if he loses, no one will give him any guarantees."
